From time to time I like to provide a brief summary of some recent court cases relative to homeschooling.? Today I?m stressing only those decided by a court of appeals or higher, not district court decisions. We?ll begin with a couple of special education decisions that together say something important about homeschooling children with special needs. Then we?ll move on to the more unseemly stuff.
Special Education
T.B. by W.B. and J.B. v. St. Joseph School District?was decided by the 8th Circuit Court in late April of 2012.? Read the full decision, which includes a comprehensive summary of the facts of the case, here.? Bottom line is that parents of special needs kids who provide home-based education need to show explicitly how their home-based program is meeting the child?s IEP if they want the school district to reimburse them for expenses.? The family in this case did not provide an education appropriate to their child?s needs, and so when they sued to have the school reimburse their expenses, they lost, both at the district level and on appeal.
Matter of Andes Cent. School Dist. v. King was decided by the New York Supreme Court in April 2012.? Here again the parents sued their school district when it refused to reimburse them for transportation to and from their child?s special education services, which the child took in addition to being homeschooled.? The New York State Education Department agreed with the parents but the School District appealed, stating that transportation wasn?t special education.? But it is, as both federal and state law clearly say, so the State Supreme Court sided with the parents.? Read the details here.? To me the significance of these two cases combined is that homeschooling parents with children with special needs should make sure that they are compliant with all laws and try to work with rather than against special education service providers.? When proper procedures are followed, as was the case here, the parents will win in court if a school district doesn?t want to play along.? But when the parents try to do it maverick style, as with the prior case, the courts will not likely be friendly.
Unseemly Stuff
It must be said over and over that it?s important not to generalize about the entire homeschooling movement based cases like these.? By definition situations that make it into court are atypical.? But having said that, such cases do help explain why so many Americans who do not homeschool look at those who do with suspicion.
People v. Goddard was decided by the California Court of Appeals in June of 2012.? The facts of the case are very sobering.? They detail the years-long sexual abuse of an adopted girl by the husband of the girl?s stepsister.? The abuse was able to go on so consistently for so long because the girl was homeschooled, and the husband was frequently left alone in the house with the girl while the stepsister was at work.? Goddard was convicted of several counts of sexual abuse of a minor.? You can read it all here.
Titus v. Titus, Decided in April of 2012 by the Nebraska Court of Appeals, is an interesting case largely because of who it features.? Phyllis Titus is very well known in the Nebraska homeschooling world, having served for several years as the point person for the Home Educators Network, a leading regional organization.? She?s been scrubbed from the site?s actual pages, but you can still find her name all over the internet from years past.? Anyway, The Tituses divorced, and Mr. Titus appealed the original decision because he thought he was having to pay too much alimony.? The court of appeals confirmed the earlier decision, citing among other things the years and years of sacrifice Mrs. Titus gave to her earning potential so that she could homeschool the couple?s two children, which both parents had always wanted her to do.? The former Mrs. Titus now can benefit financially from all those years of service.
Bowen v. Bowen, decided by the Arkansas Court of Appeals in June of 2012, is interesting mostly for the wild homeschooling set-up it divulges.? The case is really about whether grandparents have a right to see their grandchildren if a parent doesn?t want them to, but what prompted the trouble between paternal grandparents and father was a divorce followed by a decision to homeschool.? From the facts of the case, which you can read here, a husband and wife divorced, which led the husband?s father to fire his son from the family business.? This led the father to stop allowing the grandparents to visit the house, so they saw their grandkids during lunch at school.? But eventually the husband?s new wife and his ex-wife, decided to homeschool the children.? The grandparents sued to get visitation rights, which the lower court granted.? But the court of appeals reversed the decision, saying that in such cases a parent?s wishes take priority unless a very high threshold is cleared, and the grandparents didn?t clear it.? I include the case here only because it is the first example I?ve ever come across of a homeschooling situation where a divorced biological mother and the step mother who replaced her homeschool children together.
Finally, we have In re C. S. et al., decided by the California Court of Appeals in April of 2012.? It?s the kind of custody case nobody wants to hear about, for it involves the use of ?homeschooling? to mask neglect and abuse.? If you want the details you can read them here.? Bottom line is that cases like this, and there are many, need to be kept in mind by homeschoolers like David Mills, who recently expressed in the fine journal First Things his exasperation with the skepticism with which his decision to homeschool is often greeted by outsiders.? PHOENIX (AP) ? Arizona's ban on abortions starting at 20 weeks of pregnancy will take effect this week as scheduled after a federal judge ruled Monday that the new law is constitutional.
U.S. District Judge James Teilborg said the statute may prompt a few pregnant women who are considering abortion to make the decision earlier. But he said the new law is constitutional because it doesn't prohibit any women from making the decision to end their pregnancies.
The judge also wrote that the state provided "substantial and well-documented" evidence that an unborn child has the capacity to feel pain during an abortion by at least 20 weeks.
Republican Gov. Jan Brewer signed the measure into law in April, making Arizona one of 10 states to enact types of 20-week bans.
Arizona's ban, set to take effect Thursday, prohibits abortions starting at 20 weeks of pregnancy except in medical emergencies. That is a change from the state's current ban at viability, which is the ability to survive outside the womb and which generally is considered to be about 24 weeks. A normal pregnancy lasts about 40 weeks.
The New York-based Center for Reproductive Rights said it and another group that challenged the law plan to file an emergency appeal of Monday's decision with the 9th U.S. Circuit Court of Appeals.
"Today's decision casts aside decades of legal precedent, ignoring constitutional protections for reproductive rights that have been upheld by the United States Supreme Court for nearly 40 years and threatening women's health and lives," said Nancy Northup, the center's president and CEO.
Teilborg held a hearing Wednesday on a request from abortion-rights groups that he temporarily block the law's enforcement.
The abortion-rights groups' lawyer said during the hearing that the ban crosses a clear line on what U.S. Supreme Court rulings permit, and it intrudes on women's health decisions at a key point in pregnancy. Maricopa County Attorney Bill Montgomery said the state Legislature was justified in enacting the ban to protect the health of women and shield fetuses from pain.
A second Arizona anti-abortion law enacted earlier this year also faces a court challenge. That law would bar public funding for non-abortion health care provided by abortion doctors and clinics.
Both anti-abortion laws are among many approved by Arizona's Republican-led Legislature. The other laws include restrictions on clinic operations, mandates for specific disclosures and a prohibition on a type of late-term abortion.
Attorney Janet Crepps of the New York-based Center for Reproductive Rights argued at Wednesday's hearing that under Supreme Court decisions starting with the 1973 Roe vs. Wade ruling that legalized abortion, states can only regulate how abortions are performed, not ban them, before a fetus is viable.
Montgomery said that not implementing the 20-week ban would doom fetuses that might be saved due to advances in medicine.
While North Carolina has long had a 20-week ban, Nebraska in 2010 was the first state to recently enact one. Five more states followed in 2010: Alabama, Idaho, Indiana, Kansas and Oklahoma.
Along with Arizona, Georgia and Louisiana approved 20-week bans this year, though Georgia's doesn't take effect until 2013.
The Center for Reproductive Rights said none of the 20-week bans have so far been blocked by courts.

The unemployed got some bad news last week: the Federal government estimates that it overpaid more than $14 billion in unemployment benefits. This amounts to roughly 11 percent of all unemployment payments, which the recipients will have to pay back.
When it comes to collecting unemployment overpayments, the Federal government only recovers about a quarter of its losses. In fact, there?s even a procedure in place for those who have received overpayments but aren?t able to pay the money back ? they can even have the repayment amount and any subsequent fees waived. The only criterion is that the recipient must prove that they did not set out to purposefully deceive the Federal government.
The most common reason for overpayment is attributed to clerical errors that qualify an applicant for regular payment, when that person would normally not have qualified to collect unemployment. This includes people who quit their jobs, were fired for negligence, aren?t actively looking for work, or have found another job.
The overpayment amounts are significant, especially when viewed through the lens of strained state budgets; Colorado overpaid by $128 million in a single year and Indiana paid out more in incorrect benefits than correct ones.
Overpayments aren?t the only concern for the unemployed. Even though taxes aren?t taken out of your unemployment check, you?re still expected to pay tax on the benefits you collect, which is taxed as regular income.
Additionally, any supplemental unemployment benefits coming from company-funded programs are not taxed as income, but as ?wages.? Meaning: you?re going to get a W-2 for them at the end of the year and the IRS will tax you then.
In some states, you have the option to have taxes withheld at the time the unemployment check is issued. Generally, 10 percent is withheld from the check. This withholding is optional and recipients can elect to collect the entire amount and pay tax on it at the end of the year instead.
Collecting a larger check is tempting, but it?s wise to have the taxes withheld from your unemployment check. Taking a hit now is better than owing the IRS at the end of the year. If you end up with a tax refund at the end of the year instead of owing, that money can go toward any bills and expenses you incurred as a result of being unemployed.
If you still decide to not have tax withheld from your unemployment benefits, make sure to set aside a portion of each check (say 10 percent) in a high-yield, interest-bearing account.
When you receive unemployment compensation, you will get issued a 1099-G at the end of the year. This is how the IRS keeps track of any income received from governmental sources. You are required to report this as income and failing to do so might be one of the biggest tax mistakes you can make.
If you fail to report your unemployment benefits as income, it?s unlikely you?re going to end up in Federal prison for tax evasion but the fees and penalties associated with lying on your taxes are significant. And if you get audited ? even if you?re completely clean ? the process will be time consuming and potentially expensive. When it comes to paying taxes, honesty is always the best policy.
Reporting unemployment income on your taxes is easy ? there are lines on your tax forms specifically for any 1099-G income. You can also deduct a number of expenses related to your job search such as transportation, relocation costs, and seminar fees. Even the fancy paper you print your resume on is tax-deductible.
Paying taxes on your unemployment income doesn?t need to be scary ? the detriments far outweigh the benefits and you can feel better about any monetary investment you make in your job search.

When Natividad Gonzalez?s 3-year-old daughter fell off the stairs at their home in Maplesville, Ala., the panicked mother raced to the local hospital.
She carried her daughter into the emergency room and scanned the room for help, but came to halt when a doctor approached them.
?Instead of asking me what happened to my daughter, he asked me what her (immigration) status is,? said Gonzalez, 27, who emigrated from Mexico illegally nine years ago, but gave birth to her daughter in the United States, making the child a U.S. citizen. ?People think that doesn?t really happen. They say the new immigration law won?t affect people who are legal. But that?s wrong.?
As Arizona officials prepare to implement a section of its immigration law that was upheld by the U.S. Supreme Court last month, they could use the experience of Alabama as a guide.
Six states have passed laws in the last two years that require local police officers to check the immigration status of suspects if the officer believes the person may be in the country illegally. Judges blocked five of those states from implementing that law, including the Arizona case that ended up before the Supreme Court. But a federal judge in Alabama allowed that law to go into effect.
Now, nine months later, Hispanic residents complain that they?re subjected to constant harassment and racial profiling by police and other state officials in Alabama. Civil rights groups set up a hotline in the state, and more than 6,000 people have called in with complaints, said Mary Bauer, legal director of the Southern Poverty Law Center, which has helped file lawsuits to block state immigration laws.
?And this is a state with a tiny immigrant and Latino population,? Bauer said. ?I imagine this playing out in a state like Arizona, and it?s just incredibly heartbreaking to imagine the many people who will be subjected to this treatment.?

Absolutely!? My passion is to make a difference in people?s life and what better way to do it than by improving their health and longevity while teaching them to make delicious food?
Well, it?s really not that exciting but here goes. I travel quite a bit with my book, UNPROCESSED, ?speaking and doing culinary demos.? But when I am in town I wake up around 8:00am.? My handsome plant based husband, Charles, is (an associate producer on Days Of Our Lives) ?and I make his lunch and green smoothie.? Then I walk my rescued mutt, Sparky, and go to Yin yoga.? The rest of the day is spent reading health related materials like medical journal articles, working on my books and testing recipes.? I get about 500 e-mails a day so lots of time is spent answering them as I do answer all of my e-mails personally.? I take Sparky for another walk in the later afternoon somewhere really fun like the lake.? Then I make dinner for the family and watch Jeopardy.? I spend most of the evening answering e-mails and go to bed around midnight.? On the weekends I teach my culinary classes.
I don?t think snacking is a good idea.? I have to agree with Dr. Fuhrman here.? I f you are eating a nutrient rich diet and eating ENOUGH at your meals, there is no reason to snack.? You just end up eating more calories than you need.? If I did have to have a snack I would eat a piece of fruit or some steamed greens.? My motto is ?If you aren?t hungry enough to eat steamed greens, you?re not hungry.?
Most people who snack are snacking for reasons other than hunger. For about 8 years I drank a green smoothie every day for breakfast. ?I love them and still make one for Charles every morning but I stopped drinking them this year on the advice of the doctors at True Northwhere I have the privilege to teach every December.? I wanted to lose weight and they explained that those who want to lose weight should not drink their calories.? They explained that digestion begins in the mouth and by chewing your food and digesting it whole, rather than blended, about 25% of the calories are not absorbed as they are expended as energy from the chewing and digestion.? Green smoothies are great for people who don?t want to lose weight though and for children and the elderly. For breakfast I eat the most amazing oatmeal ever.? The recipe will be in my next book and I am happy to share it with you now.? For lunch I have a HUGE salad with shredded beets, cabbage, carrot, beans and a delicious fat free dressing from my next book which I will also share. If I am still hungry then I will eat a potato of one color or another.? Dinner is a soup, stew, chili or stuffed potato usually.? We don?t eat dessert anymore except for fruit

Since it is so high fat I always cut it with either garbanzo beans, cannellini beans or peas.? I also love my fully loaded Nachos.? I make a killer vegan queso!!!
For 35 years all I have ever heard is ?where do you get your protein?!!!? If I had a nickel for every time I heard that I could retire.? You can?t be protein deficient on a plant based diet unless you are calorie deficient.? I also love when I tell people I don?t eat animals and they say ?You don?t eat fish??? Even when I ate animals I didn?t eat fish!!!? Fish are not vegetables!!!
GREENS!!!? They are not only the most nutrient dense food on the planet, but I believe they are the secret weapon in health, longevity and weight loss.?
